- Walker ruled that DiPizio's claims against the state would have been limited if Erie Canal Harbor Development Corp. reached a monetary settlement with bond holder Travelers Insurance, and that DiPizio's plans to for disposing contaminated soil and using a different kind of granite were permissible under its contract.
- DiPizio was the lowest bidder on the Buffalo Canalside project at just below $20 million, and was fired by the state agency in May after the project fell behind schedule.

DiPizio filed three lawsuits on the grounds that its ability to perform contractually required work was obstructed by the state, and that it had become a scapegoat to draw attention from the agency design and constructions teams' mistakes. The project is currently half-finished, but expected to be completed next summer, with Rochester's Pike Construction Co. now serving as general contractor. DiPizio is now hoping to settle with the state out of court.
