- A Texas judge has granted an order that prevents evidence involved with a fatal accident from being destroyed, including a video recording he believes exists.
- The victim, Jose Dario Suarez, 55, was one of two men dropped into the Brazos River Jan. 28, when a lift they were secured to fell into the water beneath them. They were working on building a pedestrian bridge near Baylor University's new football stadium.
- The order from District Judge Jim Meyer was directed to Baylor, Derr and Isbell Construction, and Flintco.
Dive Insight:
Vuk Vujasinovic, a Houston attorney who represents the family, told Meyer he was worried that material evidence might be “discarded, altered or destroyed.” A second worker who was on the lift with Suarez freed himself from his harness and was relatively unharmed. Suarez drowned and his body was found about four hours after the lift went over.
